Terms of Service
Last updated: October 16, 2026
Scope and relationship to paid services
These Terms govern BlueLux LLC's website, blog, Playbook, Ask Blue assistant, public calculators, API and MCP tools, and Pool Scout at scout.bluelux.com (together, the "Digital Services"). By accessing or using the Digital Services, including the website or API/MCP tools, you agree to these Terms. If you do not agree, do not use them. A separate agreement for a particular product controls if it conflicts with these Terms.
The Service Agreement, applicable rate card, and your customer-specific Service Confirmation govern purchased pool services, billing, repair approvals, and cancellation. A Service Confirmation can be a proposal, enrollment, email confirmation, onboarding summary, or another written service record from BlueLux. These Terms do not create a different service fee or change that customer-specific record. The Privacy Policy explains how we handle information; it is not a payment authorization or messaging consent.
If you accept these Terms for an organization, you confirm that you have authority to bind it. Account and integration use require an adult authorized to enter the agreement. Reading public educational material does not enroll anyone in paid service.
Accounts, access and acceptable use
Only an adult authorized to accept these Terms may create or use an account or integration for themselves or an organization. Provide accurate account information, protect sign-in links, codes, credentials and conversation links, and promptly report suspected unauthorized access. Do not share another person's account or attempt to access information or functions you are not authorized to use.
Do not use the Digital Services to break the law, infringe others' rights, upload malicious code, impersonate others, harass people, interfere with service, evade access controls or rate limits, or extract nonpublic data. Reasonable, authorized use of published API/MCP interfaces is permitted subject to their documentation. Report a suspected security issue privately to legal@bluelux.com rather than accessing or exposing other people's information.
Educational content and Ask Blue
The blog, Playbook, calculators and Ask Blue provide general information and decision support. The Playbook describes practices intended for trained personnel. Public availability does not establish that a procedure is appropriate for your property or that you are qualified or authorized to perform it.
Calculators and treatment plans, including API/MCP results, use supplied readings, pool volume, product information and selected policy assumptions. Software defects, errors, omissions or model limits can affect results, and actual water response may differ. Verify these inputs, follow product labels and facility requirements, observe all warnings, holds and treatment limits, and retest as directed. A calculation does not certify swimming safety or regulatory compliance.
Ask Blue is an AI assistant. Its answers may be incomplete, outdated or incorrect, including when an answer cites a source. Verify relevant facts, calculations, product labels, manufacturer instructions, safety data sheets, site conditions and legal requirements before acting. Obtain a qualified professional for regulated or hazardous work. An AI answer is not a safety certification, medical or legal advice, binding service quote, booking confirmation or authorization to repair equipment.
Do not rely on these tools to monitor swimmers, detect emergencies, control safety-critical equipment or determine that swimming is safe. For an immediate threat to life or safety, contact emergency services. A response from an automated assistant is not confirmation that BlueLux staff have seen or accepted a request.
Do not submit payment-card numbers, passwords, gate codes, health information or other unnecessary sensitive information to Ask Blue. Use the designated service or payment channel for information required to deliver a purchased service.
API and MCP integrations
An API or MCP response reports the result of the requested tool operation; it does not independently create a customer contract or authorize a purchase. Estimates and calculations depend on supplied inputs and the stated assumptions. Integrators must preserve material qualifications and source information when presenting results to their users, including notices, quantities and units, ordered treatment steps, warnings, holds and matching projections. Do not present a held action as an instruction to add chemicals or a result as a safety certification.
Use only the access granted to you and only data you are authorized to submit. Keep credentials out of public code and end-user messages. Do not evade usage limits or represent that BlueLux has approved an integration merely because it uses a public endpoint.
Unless a separate written agreement states otherwise, no uptime, response-time, compatibility or indefinite free-access commitment applies. We may change, limit or retire endpoints. We aim to provide notice of material planned changes to registered integrations where practical; we may act sooner to address security, abuse or legal requirements. New charges require disclosure and acceptance before they apply. Existing paid commitments remain governed by their agreement.
Your chosen AI host, agent, integration or browser extension may also process your inputs and tool results under its own privacy practices. BlueLux does not control an independent provider merely because it can call our tools.
Pool Scout
Scout supports property research and prospect-management workflows. Address, parcel, owner, map and imagery information may come from outside sources and can be incomplete or inaccurate. A map image, inferred pool, parcel match or owner name is not confirmation of current ownership, property access, consent to solicitation or suitability for service.
You are responsible for verifying information and complying with applicable marketing, privacy, no-solicitation, trespass and communications rules. A listed address does not grant permission to enter a property or contact its occupants by any particular channel.
Upload customer lists only when you have authority to provide and use that information for the selected purpose. Do not upload sensitive information unnecessary for address discovery. Keep exported files secure and honor applicable restrictions on their use. Access to Scout does not give you ownership of third-party maps, imagery or records or a right to resell them in breach of source restrictions.
You retain rights you hold in your uploaded content. You permit BlueLux and its service providers to process it as needed to provide the requested functionality, maintain security and comply with law, subject to the Privacy Policy and any applicable business-data agreement. This permission is not an unrestricted right to publish your private customer list or use it for unrelated marketing.
Content rights
BlueLux and its licensors retain rights in their software, branding and original content. You may view public content, link to it, and use authorized tools for their stated purposes. Public access alone does not grant unrestricted commercial republication, resale or removal of attribution. A separately stated license controls material released under that license. Statutory rights, including fair use, remain unaffected.
You must have the rights needed for material you submit. We may remove or restrict material that violates these Terms or others' rights. We do not obtain ownership of your private submissions merely because you use a tool.
Communications
BlueLux sends account, security, scheduling, billing, technician-arrival, service-completion, repair-approval, equipment-alert, and customer-support communications through the channels you provide. We send automated SMS, MMS, or RCS messages only with the consent required for that message type. Accepting these Terms is not blanket consent to marketing texts, and messaging consent is not a condition of purchase.
Message frequency varies with your service schedule, requests, and account activity. Message and data rates may apply. Reply STOP to opt out. We may send one final message confirming the opt-out, and no further automated messages will be sent from that program unless you provide new consent. Reply HELP for help, or contact support@bluelux.com or 601-258-3589. Carriers are not liable for delayed or undelivered messages.
Opting out of texts does not cancel paid service or automatic renewal; use the cancellation method in the Service Agreement. Mobile numbers and messaging opt-in data are handled as stated in the Privacy Policy.
Availability, responsibility and disputes
Free informational Digital Services are provided as available. We do not promise uninterrupted availability, complete accuracy, or suitability for a particular purpose. To the extent permitted by law, we disclaim warranties that are not expressly stated for those free services. This does not change a paid-service warranty or a duty imposed by law.
Each party is responsible for its own conduct. Nothing in these Terms limits a right or remedy that applicable law does not allow the parties to limit.
We may restrict access when reasonably necessary to address a breach, security threat, or legal requirement. When feasible, we provide notice and a reasonable opportunity to correct the issue before restricting access. We may act immediately when delay would create a security, legal, or safety risk. Suspension does not let us keep a payment contrary to an applicable paid agreement or law.
California law governs, subject to mandatory protections that apply to you. Contact legal@bluelux.com about a dispute. Either party may bring a claim in a court with lawful jurisdiction, including small claims court when available. Contacting us informally does not extend a filing deadline or prevent urgent relief.
Changes and contact
We identify revisions with an actual effective date. For material changes affecting registered users or integrations, we provide advance notice through an account communication and identify when the change applies; ordinarily at least 30 days. A change required to address a security threat or legal requirement may take effect sooner; we provide notice when circumstances allow. We obtain affirmative acceptance where required. Changes do not retroactively alter an accrued claim or a specifically negotiated written commitment. Purchased service changes follow the Service Agreement.
