Agreement to Terms
By accessing our website, using our services, or entering into a service agreement with BlueLux Pool Services ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
Services Description
BlueLux Pool Services provides professional pool cleaning, maintenance, repair, and related services including but not limited to:
- Regular pool cleaning and chemical balancing
- Equipment maintenance and repair
- Pool opening and closing services
- Emergency pool services
- Pool equipment installation
- Water testing and chemical analysis
- Pool safety inspections
Service Agreements and Scheduling
Service Plans
Services are provided according to agreed-upon schedules and service plans. Service frequency and specific tasks will be outlined in your individual Service Agreement. Changes to service plans require written notice and mutual agreement.
Access Requirements
You agree to provide safe and reasonable access to your pool area during scheduled service times. This includes providing access codes, keys, or ensuring gates are unlocked as agreed. If access cannot be gained, a service charge may apply.
Weather and Seasonal Considerations
Services may be modified or postponed due to severe weather conditions, safety concerns, or seasonal factors. We will make reasonable efforts to reschedule missed services and notify you of any changes.
Payment Terms
Billing and Payment
- Payment is due according to the terms specified in your Service Agreement
- Late payments may incur a late fee of 1.5% per month
- Returned check fee: $35
- Services may be suspended for accounts more than 30 days past due
- You are responsible for all collection costs and legal fees for delinquent accounts
Service Modifications
Additional services beyond your regular service plan will be quoted separately and require approval before performance. Emergency services may be performed without prior approval to protect your pool and equipment.
Customer Responsibilities
- Maintain safe access to pool area and equipment
- Notify us of any changes to access codes, contact information, or service requirements
- Secure pets during service visits
- Maintain adequate water levels in pool
- Report equipment malfunctions or safety concerns promptly
- Comply with local health and safety regulations
- Provide accurate information about pool systems and history
Liability and Insurance
Our Liability
We maintain general liability insurance and take reasonable care in performing our services. However, our liability is limited to the cost of re-performing defective services or refunding fees for services not properly performed.
Limitations
We are not liable for:
- Pre-existing equipment defects or failures
- Damage caused by improper pool construction or installation
- Acts of nature, vandalism, or circumstances beyond our control
- Consequential damages or lost use of pool
- Damage resulting from customer's failure to follow recommendations
Customer Insurance
You are responsible for maintaining appropriate homeowner's or property insurance covering your pool and related equipment. We recommend notifying your insurance carrier of professional pool service.
Chemical Handling and Safety
We handle and apply pool chemicals according to manufacturer specifications and industry standards. Customers should not add chemicals within 24 hours before or after our service visits unless specifically instructed or in emergency situations.
Important Safety Notice:
Pool chemicals can be dangerous if mishandled. Never mix different chemicals, and always follow safety instructions. Contact us immediately if you experience any adverse reactions or have concerns about chemical application.
Service Termination
Termination by Customer
You may terminate services with 30 days written notice. Pre-paid services will be prorated and refunded for unused portions. Seasonal services may have different termination terms as specified in your Service Agreement.
Termination by Company
We may terminate services immediately for non-payment, unsafe conditions, breach of these Terms, or abusive behavior toward our staff. We may also terminate with 30 days notice for any reason.
Warranties and Disclaimers
We warrant that services will be performed in a workmanlike manner consistent with industry standards. We make no warranties regarding equipment life, chemical consumption, or pool condition beyond our direct service performance. All other warranties are disclaimed to the fullest extent permitted by law.
Dispute Resolution
Any disputes arising from these Terms or our services will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in San Diego County, California and governed by California law.
Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website or notification to customers. Continued use of our services constitutes acceptance of modified Terms.
