BlueLux Service Agreement

Last updated: September 23, 2026

Your customer-specific Service Confirmation identifies the property, services, price, billing schedule, and any negotiated exceptions. It may be a proposal, enrollment, email confirmation, onboarding summary, or another written service record from BlueLux. These terms explain performance, approvals, billing, and cancellation. View the separate rate card.

1. How your service is documented

BlueLux LLC ("BlueLux," "we," or "us") provides service for the customer and property identified in the written service details we send you. We call that customer-specific record your Service Confirmation. It may be a signed proposal, online enrollment, email confirmation, onboarding summary, or another written service record from BlueLux. For an acquired or manually onboarded account, it may also be the most recent written service summary or invoice we sent you. It does not need to be labeled an "order."

Your Service Confirmation identifies the property, covered pool or other water bodies, plan or services, price, property adjustments, start date, billing schedule, promotion and expiration, and any negotiated exceptions. An estimate or quote is not a confirmed booking until BlueLux confirms the service.

Your Service Confirmation, this Service Agreement, and the rate card provided or linked with your service terms form the agreement. A customer-specific term that you and BlueLux accept in writing controls over a conflicting standard term. Written acceptance can appear in a signed proposal, onboarding record, email, text, or other record that clearly shows the agreed term. A job-specific contract required by law controls the work it covers. Otherwise, the service-specific provisions below control their subject, this Service Agreement controls how service is provided, and the applicable rate card controls standard prices. The customer-specific price and scope in your Service Confirmation control.

Section 11 explains how future changes work. A later website update does not change completed work, an accepted fixed-price job, a negotiated exception, or the protected initial Lux price. The Terms of Service govern BlueLux digital products. The Privacy Policy explains how we handle information.

2. Service schedule and missed visits

Basic is scheduled every two weeks. Full, Premium and Lux are scheduled weekly. We follow that cadence through fifth weeks; service is not limited to two or four visits in a calendar month. Monthly pricing is a flat subscription price, not a per-visit charge or a promise of a fixed annual visit count.

Normal business hours are Monday–Friday, 8 a.m.–6 p.m., Pacific time, excluding the holidays below. We establish a usual route day. Arrival times can vary, and a visit may move within the same service week. We notify you when a schedule change is expected to continue beyond the current service week. A temporary route change does not remove our responsibility to complete a visit missed for reasons within our control.

Routine service does not take place on New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day or Christmas Day. Only a visit falling on one of these listed dates is a holiday skip; this provision does not establish additional holiday-week closures or substitute observed dates.

SituationService and billing outcome
Listed holiday falls on your scheduled dayVisit skipped; no automatic makeup or credit.
Severe weather, wildfire, flooding or another condition makes work unsafe or ineffectiveWe may skip; no automatic makeup or credit. We document the reason and notify you.
Safe access allows chemistry work but weather prevents effective cleaningWe may test and balance water, service applicable baskets and check equipment. The report identifies the limited work. This counts as that scheduled visit.
Locked gate, loose animal, occupied pool, blocked equipment or another customer-controlled access problemVisit may be skipped; no automatic makeup or credit. A requested separate return visit requires an approved price.
BlueLux staffing, routing or another issue within our controlWe arrange a makeup. If not completed within seven calendar days, we credit the missed visit.
A temporary issue can be corrected during the scheduled service dayWe make reasonable efforts to complete that visit before treating it as missed.

Missed-visit credit: BlueLux divides the recurring maintenance price for that billing period by the number of visits that would normally fall in the period before holiday, weather, or access exclusions. We apply one visit's share to the next invoice or refund it if service ends.

These exclusions address individual disruptions. If a continuing disruption prevents service for more than 14 consecutive days, we contact you to agree on suspension, a revised schedule or cancellation and the treatment of prepaid service. We do not automatically continue full billing indefinitely for unavailable service.

3. What each plan includes

The rate card states the base price and property adjustments. Included tasks apply to the contracted property in normal operating condition during scheduled visits. For this agreement, normal operating condition means the covered pool and equipment are accessible and functioning and do not require recovery, repair, or unusually heavy work beyond the recurring tasks in your Service Confirmation. A service report records completed work and relevant findings.

Basic: water testing and balancing, routine basic chemicals, a visual and operational equipment check, and a digital service report. Physical cleaning, basket emptying, filter and salt-cell cleaning, specialty chemicals, and repairs are separate.

Full: Basic chemistry service at weekly cadence, plus surface skimming, basket emptying, brushing and manual vacuuming when pool conditions require them, and equipment issue reporting. Manual vacuuming is not promised at every visit or on a fixed schedule. If the pool regularly needs more floor cleaning than routine service provides, BlueLux may require an effective automatic cleaner or quote a property-scope adjustment before continuing that extra work. Filter cleaning, salt-cell cleaning, specialty chemicals, repairs, and dedicated visits are separate unless your Service Confirmation says otherwise.

Premium: Full service, two filter cleanings per service year, up to four salt-cell cleanings when inspection or manufacturer guidance shows cleaning is needed, routine specialty chemicals, the qualifying on-route repair benefit in Section 5, and a single concierge contact for scheduling and service questions. Priority scheduling is subject to availability and is not an emergency-response guarantee.

Lux: Premium maintenance and chemical benefits, with the Lux repair and dispatch terms replacing the Premium limits. Lux amenities can include light deck and leaf blowing during weekly visits, towel service, a stocked sunscreen station, party preparation and cleanup twice per service year, two lifeguard events per service year, and smart monitoring.

Your Lux Service Confirmation must state the towel quantity and ownership, sunscreen supply, covered deck area, party-service hours and tasks, included guard count and event duration, booking notice, monitoring-equipment ownership and costs, connectivity requirements, and return arrangements. Only the amenities listed there are included.

4. Chemicals, filters and salt systems

Basic chemicals are routine chlorine sanitizer, pH reducers/increasers, alkalinity increaser and routine chlorine shock for an otherwise clean, functioning pool. Premium and Lux also include normal maintenance quantities of cyanuric acid, calcium-hardness increaser, phosphate remover, enzymes, algaecide, clarifier and stain/scale/metal-control products selected by BlueLux. Normal maintenance quantities are the amounts BlueLux reasonably expects for ordinary seasonal care of an otherwise clean, functioning pool; they do not include the abnormal causes listed below.

Ordinary seasonal variation is part of normal maintenance. Pool salt, startup or recovery treatments, contamination response and unusually large demand caused by leaks, failed equipment, construction, fire/ash or other abnormal conditions are separate unless the purchased service expressly includes them. We explain separately billable products and labor and obtain approval before charging, except within an applicable accepted spending authorization. Routine application of chemicals included in your plan does not carry an additional dosing-labor charge.

Filter cleaning is required when indicated by manufacturer guidance, pressure, flow, debris or use; twice yearly is a normal baseline, not a guarantee that two cleanings will always be sufficient. We normally inspect salt cells about quarterly and clean only when inspection or manufacturer guidance shows cleaning is needed. Inspection does not automatically consume a cleaning benefit.

Plan filter benefits cover the cleaning service. Replacement cartridges, grids, sand, glass and other replacement media are separately quoted. The quote identifies any DE recharge material and other consumables not expressly included. Cleanings beyond a plan's included count are billed at the applicable on-route or standalone rate after approval.

You must maintain adequate water level, safe access and functioning circulation, filtration and sanitation equipment. Tell us about equipment failures, heavy use and products added near service visits. Never mix pool chemicals. Follow product labels and our site-specific restrictions on swimming or equipment use. Extra work resulting from a maintenance problem still requires the approval described in Section 5.

5. Repair benefits and approval for extra charges

We state the scope and price before separately billed work begins. Written approval may be a signed proposal, Service Confirmation, change order, email, text, or electronic approval from you or your authorized contact. If diagnosis reveals additional work, we stop and request approval before exceeding the approved scope or amount. We may shut down unsafe equipment and notify you; shutting equipment down does not authorize extra charges.

Basic: separately billed work requires approval.

Full — spending authorization: By accepting Full service under this agreement, you authorize necessary minor on-route repairs when the combined retail price of all related parts is below $50 and the extra labor is no more than 30 minutes during that scheduled visit. Parts and labor are billed separately: $50 for up to 15 minutes or $90 for more than 15 and up to 30 minutes, plus parts and applicable tax. We report the work and charges. We obtain approval before exceeding either limit or arranging a separate trip. We do not split related work to avoid a limit. This spending authorization applies to BlueLux services; licensed contractor work requires the separate agreement described in Section 5A. A written customer-specific spending restriction controls.

Premium: For an eligible minor repair during a scheduled visit, qualifying parts with a combined retail price below $50 and the first 30 minutes of labor are included. If more labor is needed, the first 30 minutes remain included and we quote the rest before continuing. If qualifying parts total $50 or more, the entire repair is customer-paid; there is no $50 credit or automatic authorization.

Lux: Qualifying minor repairs with combined retail parts below $500 include the repair labor and one normal weekday return visit when needed to finish that repair. If qualifying parts total $500 or more, the entire repair is customer-paid; there is no $500 credit. The Lux benefit replaces the Premium repair limit.

Thresholds use BlueLux's combined retail price for all related repair parts before tax. Exactly $50 does not qualify under Premium, and exactly $500 does not qualify under Lux. A qualifying included repair has no separate charge for its included parts or labor.

Premium and Lux repair coverage does not include pumps, heaters or heat pumps, salt cells or complete salt systems, filter tanks, automation controllers or boards, cleaners, lights, blowers, complete equipment assemblies, replacement filter parts or media, or work BlueLux does not offer. Eligible minor components can include gauges, external seals, small valves, actuators, temperature or flow sensors, air-relief assemblies, pump lids, and accessible minor PVC repairs.

Coverage also excludes documented pre-existing defects, deferred maintenance, damage, and previously recommended work. Before coverage begins, we provide the baseline findings, excluded work, and coverage start date. We do not label a later problem "pre-existing" merely because it is expensive.

Paid dispatch follows the rate-card dispatch table, including the Premium and Lux discounts. Covered repair labor is not billed again. A diagnosis can identify a problem without fixing it; agreed diagnostic time remains chargeable.

5A. Licensed repairs and equipment installation

BlueLux provides ongoing pool care, equipment checks and customer coordination. Work requiring a California contractor license is contracted with and performed by an appropriately licensed contractor under a separate job-specific agreement. BlueLux remains your contact for scheduling, communication and follow-up.

Before a representative offers or negotiates licensed work, you receive the legal business name and CSLB license number of the contractor they represent. A home improvement salesperson must be registered and authorized for that contractor where required. The contractor’s agreement identifies the scope, final price, payment recipient and schedule, permit responsibilities, workmanship terms and required notices. The contractor is responsible for its licensed work and applicable contractor obligations.

BlueLux may separately provide equipment, service documentation and administrative support, as stated in the proposal. The repair benefits and limits in Section 5 still apply; any covered work and additional customer charges are identified before approval. Ordinary service enrollment, a plan spending limit or a saved-card authorization does not by itself authorize a licensed-work contract or payment. Each party remains responsible for its own services and obligations.

6. Annual benefits

A service year runs from your plan start anniversary through the day before the next anniversary. Included annual benefits have no cash value and do not roll over. BlueLux uses a cleaning or treatment benefit only when inspection, test results, or manufacturer guidance indicates the work is needed. For example, an allowance of four salt-cell cleanings does not mean we will perform four unnecessary cleanings.

An upgrade does not reset the service year or restore benefits already used. We subtract benefits already used from the upgraded annual allowance. A downgrade ends future access to the higher-tier benefits on its effective date; we do not charge back ordinary benefits already used. Your Service Confirmation states any different first-year arrangement.

If BlueLux cannot staff a confirmed included Lux event, you may choose a suitable replacement, a rescheduled date you accept that does not consume the benefit, or an agreed credit.

7. Billing and promotions

Subscriptions are charged monthly on the billing schedule in your Service Confirmation. We show any initial partial-month charge or promotional period before you accept it. Your Service Confirmation states the total recurring charge, property adjustments, applicable tax, promotional price and expiration, and the price that follows. We give advance notice of billing-date or payment-term changes and obtain consent when the law requires it.

Invoice customers: Your Service Confirmation states the invoice schedule and due date. If it uses a first-of-month schedule, we send the invoice at least seven days before the first. A late-issued invoice provides at least seven days to pay. We give existing customers notice before changing their payment terms.

A saved-payment authorization covers the disclosed recurring charge, work you separately approve, and charges within an accepted Full spending authorization. It does not authorize other extra charges. We provide a receipt or itemized invoice. One-time services are billed after completion unless their accepted terms call for lawful prepayment. The event provisions below explain event-reservation payments.

We notify you of a failed or overdue payment and allow seven calendar days to bring the account current before suspending service for nonpayment. You remain responsible for completed work. We do not continue recurring charges indefinitely for service we decline to provide.

8. Cancellation and termination

Basic, Full and Premium continue month to month until canceled. You may stop automatic renewal at any time by emailing support@bluelux.com or calling 601-258-3589. We do not require seven days' notice or another renewal payment simply because you cancel close to the renewal date.

Cancellation stops the next renewal when we receive it. Service ordinarily remains available through the paid billing period, without a partial-month refund if you choose not to use it. We honor a request to stop visits sooner. A renewal charge processed after a timely cancellation is reversed. Other refund and cancellation rights required by law still apply.

Lux has an initial 12-month term, with start and end dates in your Service Confirmation, and then continues month to month. You may turn off renewal during the initial term without starting another 12-month commitment. Your Service Confirmation states any final partial billing period.

Ending Lux service early. Lux repair coverage requires completing the initial 12-month term. If you end service before completing that term, you must reimburse BlueLux for its documented actual parts and labor costs for repairs provided under that coverage, less any amounts already reimbursed for those repairs. This is actual repair cost, without retail markup; ordinary maintenance and a separate cancellation penalty are not added. We provide an itemized record. This provision does not apply when BlueLux ends service, when you end service because of BlueLux's material breach, or where applicable law prohibits the charge. Turning off renewal while completing the initial term does not trigger reimbursement.

When BlueLux ends or suspends service. We may suspend or end service for nonpayment after the notice in Section 7. We may act sooner when an unsafe condition, denied access, threat, harassment, unlawful conduct, or another serious problem prevents lawful and safe service. For another reason, we may end service on 30 days' written notice. We refund the unearned portion of prepaid service, after subtracting completed work and other authorized charges. If BlueLux ends Lux service, the early-exit reimbursement above does not apply.

9. Service correction and repair warranty

Tell us promptly about an omitted contracted task, preferably within seven days of the visit, using the service-report contact or support@bluelux.com. We investigate and arrange correction. If we confirm an omission and cannot reasonably correct it, we credit or refund the affected service. A later report does not waive a right protected by law.

BlueLux repair labor has a 90-day limited workmanship warranty beginning when that repair is completed. Tell us the property, repair date, and problem. If our repair work is defective, we correct that work without charging again. The warranty does not cover an unrelated failure, normal wear, misuse, a third-party change, or a pre-existing problem unrelated to our repair. Manufacturer warranties apply to parts and equipment. For licensed contractor work, the contractor’s agreement states its workmanship warranty and correction obligations; BlueLux remains available to help coordinate follow-up. Each provider remains responsible for its own work and any product obligations that apply to it.

We perform the agreed work with reasonable care and remain responsible for damage directly caused by our failure to do so. We do not guarantee equipment life, uninterrupted operation, or a particular water condition despite weather, bather load, leaks, failed equipment, or other causes outside our control. We also do not guarantee the prevention of every injury. You are responsible for maintaining property insurance appropriate to your pool and related equipment. Insurance does not set or cap a customer's legal recovery. Nothing in this agreement limits a right or remedy that applicable law does not allow the parties to limit.

10. Service-specific provisions

These provisions apply only when you purchase the service they describe.

Drain, exchange, and refill. Emptying all or much of an in-ground pool creates serious structural risk. Groundwater and soil pressure can crack, shift, cave in, collapse, or lift the pool shell out of the ground (often called "pool pop"), even when the drain is performed correctly. These conditions can be hidden and cannot always be predicted or controlled. By authorizing a full or substantial drain, the property owner accepts these inherent site and structural risks. BlueLux is not responsible for damage caused by groundwater, hydrostatic pressure, soil movement, pre-existing defects, failed or inadequate relief equipment, construction defects, or other conditions outside BlueLux's control. BlueLux may delay, stop, or decline drain work when conditions appear unsafe or discharge would be prohibited.

Your Service Confirmation states the planned water volume or exchange amount, discharge method, startup work, and required approvals. You supply the refill water and monitor the refill unless continuous supervision is expressly included. The Rate Card identifies which services include the routine chemicals needed to rebalance the water after refill. Repairs, filter replacement, bulk salt, water charges, abnormal chemical demand, extra exchanges, and unrelated surface work require separate approval. A customer-managed or third-party-managed refill startup does not include BlueLux performing or supervising the drain.

Reverse-osmosis coordination. BlueLux may help arrange a specialist for reverse-osmosis water treatment. A separate quote identifies the provider, scope, price, payment recipient, availability, and responsibility for the work. BlueLux does not publish standard RO volume-band prices or represent that it performs the treatment. Any coordination fee is disclosed before acceptance.

New-surface startup. The standard program lasts ten days, includes at least seven visits, and includes normal startup chemistry. The written schedule assigns daily brushing and nonvisit-day tasks to BlueLux or the customer. "Daily brushing" does not mean daily BlueLux attendance unless the Service Confirmation says so. Manufacturer and installer cure instructions control. Your Service Confirmation states who is responsible for any remaining cure-period tasks after day ten and identifies the swimming restrictions. We quote added care before performing it.

Green-pool recovery and tile cleaning. Your Service Confirmation states the treatment scope. Recovery depends on initial condition, safe access, and functioning equipment. A treatment does not guarantee that swimming will be safe within 24 to 72 hours; swimming resumes only when applicable water-quality and safety conditions are met. For tile and scale work, we explain treatment limits and known surface risks before approval. Etched, damaged, or stained surfaces may not return to an undamaged appearance. Additional work requires approval.

Visual condition assessment. This is a visual, non-invasive review of accessible pool and spa conditions at the visit, followed by the agreed report. It is not a safety certification, code-compliance determination, structural opinion, leak-detection service, invasive inspection, electrical or gas diagnosis, or guarantee of future performance. Concealed areas and disassembly are excluded. The report identifies visible findings and recommended specialist follow-up.

Who performs the work. BlueLux services may be performed by BlueLux or our authorized subcontractors within that service scope. Work requiring a contractor license follows the separate contractor agreement described in Section 5A. We confirm separately billed work and pricing before it begins.

Private event lifeguards. Your Service Confirmation states the location, date, start and end times, staffing, and total price. The standard reservation includes one guard for three hours and is confirmed after the required payment succeeds. Approved additional staffing and time are separate. An included Lux event uses the allowance in the customer's Service Confirmation.

Tell us about swimmer ages and abilities, expected attendance, slides, diving boards, inflatables, alcohol, and other material risks. We assess staffing and site suitability before confirmation and may require more guards. Guards need unobstructed access and authority to pause unsafe swimming. Lifeguard supervision cannot prevent every accident. Hosts remain responsible for guest conduct and for minors outside the area or time the guard is assigned to supervise.

Cancel or reschedule at least 24 hours before the confirmed start for a full refund of the prepaid event fee. A cancellation or reschedule within 24 hours receives a 50% refund, unless the law requires a different result. We do not retain charges for additional time or staffing that was never provided unless you separately accepted a lawful reservation charge.

If BlueLux cannot provide confirmed service, we refund the unperformed service. If weather or another unsafe condition outside your control prevents the event from starting, you may reschedule or receive a full refund. If it stops after service begins, we refund approved charges for staffing or time not provided. If an undisclosed customer-controlled hazard causes the event to stop, we itemize performed time and any lawful disclosed cancellation charge; we do not charge twice for the same loss.

11. Changes, notices and legal rights

Except for recurring-fee changes described next, we give at least 30 days' advance written notice of material changes to standard service terms, identifying the change, effective date, and cancellation method. We send recurring-fee changes 7 to 30 days before they take effect, as required by the applicable renewal rule. We obtain affirmative agreement when required. Continuing service does not replace consent required by law.

During the initial Lux term, the agreed recurring price remains fixed except for an accepted scope change, a tax change lawfully passed through, or the expiration of a promotion disclosed and accepted at enrollment. A materially adverse change to another initial-term benefit requires your agreement or an option to leave the affected commitment without an early-exit charge. Other updated standard terms can govern future service after the notice process, subject to negotiated exceptions.

We provide renewal, promotion-expiration, and annual reminders required by law. Electronic acceptance records identify the Service Confirmation and document versions accepted. You may request a copy. Electronic signing requires a deliberate acceptance action. Visiting a public page does not enroll you or authorize payment.

California law governs, subject to mandatory consumer protections. Contact support@bluelux.com to try to resolve a concern. Either party may bring a claim in a court with lawful jurisdiction, including small claims court when available. Informal contact does not extend a filing deadline or prevent urgent relief.

If a provision cannot lawfully be enforced, the rest of the agreement continues where legally appropriate. Statutory cancellation, refund, warranty, and other nonwaivable rights control. We provide translated contracts and disclosures when legally required.
